American Pool & Spa Service Agreement

By checking "I agree" box below you are agreeing to the Terms and Conditions of American Pool & Spa Cleaning Service. Terms of Service: 1. Customer agrees to pay their quoted weekly pool cleaning rate, plus cost of chemicals. We use the latest in digital pool service software to compile a detailed report on the condition of your pool and equipment, as well as weekly chemical readings. 2. Initial Startup Visit: It is important that your pool be clean, algae free and chemically balanced when we begin your monthly service. On pools that need cleaned before we start service we provide the initial startup visit at a charge of $70.00 per hour plus chemicals. The regular monthly cleaning contract begins the week after the initial startup visit. 3. Equipment Problems: It is up to American Pool and Spa to keep your pool running, and in top condition. By signing this contract, you agree that needed repairs and replacements under $200 do not need prior authorization. You will be notified, and approval will be requested for maintenance issues that will cost over the approved amount. American Pool & Spa Service is not responsible for issues resulting from client not authorizing needed maintenance. 4. Pets: It is the customer’s responsibility to contain and restrain all pets. We will do our best to keep the gate closed at all times, but we cannot be responsible if a pet gets out while we are doing our job. In addition, the customer accepts responsibility for any injuries inflicted by pets on our technicians. 5. Access: The customer must provide ready access to the maintenance tech on the day of service, either by providing a key, gate code, or insuring the pool and equipment area are unlocked. No refunds will be given for lockouts. 6. Holidays: We observe five holidays per year: Fourth of July, Thanksgiving, Christmas Eve, Christmas Day and New Year’s Day. If your normal visit falls on one of these days, your pool will not be cleaned. 7. Water Level: It is the customer’s responsibility to maintain the water level. We cannot be responsible for any equipment damages or other issues that arise as the result of low water level in the pool. 8. Salt Chlorinators: Salt is a corrosive mineral and American Pool & Spa cannot and does not accept any responsibility for any damage, staining, corrosion or deterioration of any of the pool equipment or surfaces that may result from the use of salt in the pool. Salt cells will be cleaned twice a year and an extra charge of $30 per cleaning will be billed accordingly. 9. Heavy Leaf Fall: During certain times of the year, due to heavy leaf fall, it is advisable for the homeowner to empty the skimmer baskets between our visits. This will help to ensure that the equipment is not damaged due to lack of water flow. Additional fees may incur for excessive debris in your pool. Not all leaves will be removed during this time. 10. Extra Charges: In the event the pool requires extra cleaning due to vandalism, poor drainage, dead animals or other natural disasters and/or human factors, there will be an additional charge of $70.00 per hour plus chemicals for this additional work. Filters require cleaning at least twice a year. These cleanings are done in a cyclical fashion and prior approval will not be obtained, and an extra charge of $70 per cleaning will be billed accordingly. 11. Payments: Invoices are delivered via email the 1st day of the following service month, and due on the 15th. A late payment of $25.00 will be added for payments not received by the 1st of the following month.. If payments are not received within 45 days of the invoice date, services will be suspended. Cancellation: It is understood that this is an ongoing agreement to clean your pool and/or spa on a weekly basis. If at any time you wish to cancel service, written and/or email notification to American Pool & Spa Service is required to the address at the bottom of this form. Restarting the service may incur a one-time cleaning fee to bring the pool back up to American Pool & Spa Service standards. 13. Liability: By servicing your pool/hot tub you agree to hold American Pool & Spa Service, LLC and its affiliates harmless of all liabilities and claims for damages and/or suits for or by reason of any injury, or death to any person or property of the permittee, its agents or employees, or third parties, from any cause or causes whatsoever while in or upon said premises or any part thereof during the term of this agreement. 14. Sale Of Property: If a customer places their property on the market for sale, we require full monthly payment prior to providing services. We will continue to require full monthly payment prior to service until the property is sold. 15. Pool Sweep: Customer agrees to keep a working and properly functioning pool sweep in their pool, running a minimum of two hours each day. Failure to do so will result in an immediate suspension of service.
